These Terms of Use ("Terms") are a binding agreement between you ("you" or "your") and Zrionix Technology, INC, the company that creates and publishes EmberFree ("EmberFree," "we," "us," or "our"). They govern your use of the EmberFree mobile application and related services (together, the "App" or "Service").
Please read these Terms carefully. By downloading, installing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
By using the App you represent that you are at least 18 years of age. The App is intended solely for adults and is gated by an 18+ age confirmation on first launch. If you are under 18, you may not use the App. You also represent that you have the legal capacity to enter into these Terms and that your use of the App complies with all laws that apply to you.
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use one copy of the App on an Apple-branded device that you own or control, solely for your own personal, non-commercial use, as permitted by the App Store Terms of Service.
You agree that you will not, and will not permit anyone else to: (a) copy, modify, or create derivative works of the App; (b) reverse engineer, decompile, or disassemble the App, except to the extent that applicable law expressly permits; (c) rent, lease, lend, sell, sublicense, or otherwise commercialize the App; (d) remove or alter any proprietary notices; or (e) use the App in any unlawful manner or in violation of these Terms.
EmberFree is a motivational and educational tool designed to support people who are trying to stop vaping and stay nicotine-free. Features may include:
We may add, change, suspend, or remove features at any time, and we may impose limits on certain features or restrict access to parts of the Service without notice or liability.
EmberFree is designed to be used anonymously. You do not create a traditional account and are not asked for an email address, real name, phone number, or other real-world identity. Instead, the App uses anonymous authentication that assigns your device a random, anonymous user identifier, and your community activity appears under an anonymous handle.
Because there is no login or recovery credential, your progress and data are tied to that anonymous identity on your device. If you delete the App, delete your data, or lose access to your device, that data may be permanently unrecoverable. You are responsible for the activity that occurs under your anonymous identity.
The core quit toolkit is free. EmberFree Premium is an optional, auto-renewable subscription that unlocks additional features (which may include, for example, a streak shield, expanded AI coaching, trigger insights, and additional themes and milestone styles).
Prices are in U.S. dollars and may vary by region and over time; the price shown in the App at the time of purchase applies. Subscriptions are sold as in-app purchases and are billed to your Apple ID account at confirmation of purchase. Payment is handled entirely by Apple; the App never receives or stores your payment card details. We use RevenueCat to manage and verify subscription status.
All purchases are processed by Apple and are subject to Apple's policies. We generally cannot issue refunds directly; refund requests are handled by Apple through your App Store account.
Apple's standard EULA also applies. Unless we present you with a different custom license, your license to use the App is governed by the Apple Licensed Application End User License Agreement (Standard EULA), in addition to these Terms. If there is a conflict between these Terms and the Apple Standard EULA regarding your use of the App, the Apple Standard EULA governs to the extent of that conflict.
EmberFree includes an anonymous community where members share encouragement and progress. To keep it safe and supportive, you agree that you will not post, submit, or share content that:
Moderation and reporting. We provide tools to report, filter, and block content and users, and we ask you to use them. New posts pass through an automated objectionable-content filter, and every member can report or block others. We operate a zero-tolerance policy for objectionable content and abusive behavior: we will remove objectionable content and eject the user who provided it within 24 hours of becoming aware of it (including through a report). We also reserve the right to review, moderate, remove, or restrict any content, and to suspend, disable, or terminate the anonymous identity or access of anyone who violates these Terms — at our discretion and, where appropriate, without prior notice. Community content is generated by users; it does not reflect our views, and we are not responsible for it.
You retain ownership of the content you create in the App, including community posts and messages ("Your Content"). You are solely responsible for Your Content and represent that you have the right to share it.
To operate the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute Your Content solely for the purpose of providing, maintaining, moderating, and improving the App and its community features (for example, showing your posts to other members under your anonymous handle). This license ends when Your Content is deleted, except to the extent it has been shared with others who have not deleted it, or where we must retain copies to comply with law. We do not sell Your Content and do not use it for third-party advertising.
If you use the optional AI craving coach, the messages you send are transmitted to a third-party AI provider (xAI / Grok) solely to generate a reply and return it to you. Responses are generated by an automated system, may be inaccurate or incomplete, and are for general motivational and educational support only. AI responses are not professional, medical, or mental-health advice. Do not send information you consider sensitive, and do not rely on the AI coach for any medical, safety, or emergency decision. EmberFree is a motivational and educational tool only. It is NOT a medical device, and it does not provide medical advice, diagnosis, or treatment.
The App does not diagnose, treat, cure, prevent, or monitor any disease or health condition. Streak information, health-recovery timelines, savings estimates, community messages, and AI coach replies are general and informational, and may not reflect your individual circumstances. They are not a substitute for professional care.
Always consult a qualified healthcare professional before making decisions about quitting nicotine, your health, medications, or any treatment, and about any questions you may have regarding a medical condition.
The App is not for emergencies. If you think you are experiencing a medical or mental-health emergency, or are in danger, stop using the App and immediately call your local emergency services (for example, 911 in the United States) or a local crisis line.
Your use of the App is also governed by our Privacy Policy, which describes what we collect and how we use it. In summary, the App is built to be privacy-preserving: it uses anonymous authentication (no account, email, or real name), it does not use advertising SDKs or advertising identifiers, it does not track you across other apps or websites, and we do not sell your data.
Within Settings, you can export your data at any time and delete your data at any time. Deletion is permanent and irreversible — it removes your anonymous identity and associated data and cannot be undone.
The App, including its software, design, text, graphics, logos, and the "EmberFree" name and marks, is owned by us or our licensors and is protected by intellectual-property laws. Except for the limited license granted in these Terms, no rights are granted to you. You may not use our name, logo, or branding without our prior written permission.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT IT WILL HELP YOU QUIT OR STAY NICOTINE-FREE, OR THAT ANY INFORMATION PROVIDED IS ACCURATE OR COMPLETE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR HEALTH OUTCOMES, ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, FOR THE APP IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) TWENTY U.S. DOLLARS ($20). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
You agree to defend, indemnify, and hold harmless EmberFree and its developer from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the App; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party.
These Terms remain in effect while you use the App. You may stop using the App at any time and may delete your data in Settings. We may suspend or terminate your access to the App or the community, in whole or in part, at any time — including for violation of these Terms — with or without notice. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and governing law) will survive.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide notice in the App. Changes take effect when posted. Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms. If you do not agree, stop using the App.
These Terms are governed by the laws of the United States, without regard to its conflict-of-laws rules. Subject to applicable law, you agree that any dispute not resolved informally will be brought exclusively in a court of competent jurisdiction in the United States, and you consent to its jurisdiction. Nothing in these Terms limits any consumer rights that cannot be waived under the law where you live. This section does not limit any rights Apple may have or any terms between you and Apple.
These Terms are between you and EmberFree only, not with Apple, and Apple is not responsible for the App or its content. Apple has no obligation to provide any maintenance or support for the App. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the App, and any claims relating to the App's failure to conform to any warranty are our responsibility, not Apple's. Apple is not responsible for addressing any claims relating to the App, including product-liability, regulatory, or intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not on any U.S. Government restricted-parties list.
